Privacy Policy We want to protect the privacy of visitors to our website and that of our clients, and other individuals. Please read the following policy; it will help you to understand how we use your personal data. We may change our privacy policy at any time without giving you notice, so please check it each time you visit this website.

When you make a purchase with us, we collect and store your personal information. This information is stored on a secure website. If you purchase a subscription or mentored programme, you are automatically added to our mailing list, because the emails form part of your subscription package – it’s our way of letting you know what you are receiving as part of your subscription/programme for that month. We may also contact you directly if there are any issues with your account.

If you make any other purchase, there is a check box on the checkout page which you can uncheck to opt out. There is a double opt-in confirmation process for this data collection, so you need to consent via an email that will be sent to your inbox. Your email address will be used to communicate with you about the course you have taken and about future courses. We may also contact you directly if there are any issues with your account. You can opt out of this at any time by clicking the link provided in every email.

These details are used only by Mixed Up Creative and our newsletter client (AWeber) in order to communicate with you. Details will never be passed or sold to other third parties.

If you buy a kit or customer offer, these may be provided by a third party partner and you will give your address and email details to them in order to get your product shipped to you – their terms and conditions may be different so please read them accordingly before purchasing. They will retain your details for the purposes of communication with you about your purchase(s).

We do not collect or store any financial information from you – this is held by our secure and well-respected payment option providers. We may disclose personal information if required to do so by law, Court Order, or for the purposes of prevention of fraud or other crime or if we believe that such action is necessary to protect and defend the rights, property or personal safety of Mixed Up Creative, our website or its visitors. We cannot guarantee the privacy of personal information you transmit over the web or that may be collectable in transit by others, including contractors who provide services to us.

Terms of Supply This page tells you the terms on which we supply any of the products listed on this website (our site) to you. Please read these terms of supply carefully before ordering any products. You should understand that by ordering any of our products, you agree to be bound by these terms. Please understand that if you refuse to accept these terms, you will not be able to order any products from us. We have the right to revise and amend these terms of supply from time to time. You will be subject to the policies and terms supply in force at the time that you order products from us.

Purchase Terms Access to the products will only pass to you when we receive full payment of all sums due in respect of the products. You will be granted lifetime access to your purchase, meaning that you can continue to have access to the workshop for as long as Mixed Up Creative Academy continues to trade. We reserve the right to cancel accounts which have not been accessed for over 12 months, if required for housekeeping or data security reasons. You will lose access to your purchases if you: remove your account from the site, or are removed by the site admin for misconduct or misuse of the site or our products.

Consumer rights and cancellation Digital products do not fall within the ‘cooling off’ 7 day period required under UK Law. If you change your mind after purchase, you are not entitled to a refund – this is because you will get instant access to the content and the downloadable resources. As instant access is granted upon payment, all purchases are non-transferable and non-refundable.

Product kits and customer offers: Kits and other physical goods are covered in law by a 7 day ‘cooling off’ period. We supply some kits and some are supplied by our partners. You have a right to cancel an order seven working days from the day after you receive your goods. Where kits are provided by a partner, this will be clearly stated at point of sale. Where you purchase third-party kits provided by our partners, this transaction is between you and the third-party supplier, and will be covered in their own terms and conditions of sale and Mixed Up Creative cannot get involved in any discussions regarding third-party kits.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation. It is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our Order Confirmation procedures. If the correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions or reject your order and notify you of such rejection. We are under no obligation to provide any Product or Event to you at the incorrect (lower) price, even after we have sent you an Order Confirmation, if the pricing error is obvious and could have reasonably been recognised by you as an error. Contracts and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any such dispute or claim will be subject to the nonexclusive jurisdiction of the courts of England and Wales.

Site Etiquette Our classes have a comments section so you can ask questions and make comments. We operate a zero tolerance policy on abusive or discriminatory comments or ‘trolling’ and anyone making such comments will be removed immediately without discussion. No refunds will be offered where members are removed for abusive behaviour. Your account will be terminated and you will no longer have access to any of your purchases.

Intellectual Property All intellectual property rights (including but not limited to copyright) in all materials at all times belong to and shall remain vested in us and our Tutors and neither you nor any other person shall obtain any intellectual property rights or any other interest, right or title whatsoever in or to any materials or any part thereof save as otherwise expressly granted. The instruction provided is for your own personal, educational, noncommercial purposes. You shall ensure that materials are only accessed by you and you must not make available, copy, reproduce, disseminate, retransmit, sub-license, share, distribute, sell, publish, broadcast or otherwise supply in any medium and in any manner any such materials (or any part of them) to any third party. You must not use any of the workshop content, including images and downloads, for any purpose other than your own personal learning experience.

Breach of our copyright/IP rights over the protected content herewith will result in the closure of your account and permanent exclusion from the site. In the case of any breach of copyright/IP no refunds or compensation will be offered when your account is terminated.

Breaches of our policy include (but are not limited to):
1 Sharing your login information with another party who then uses it to access the private area of the website;
2 Using any of our classes as the basis of a tutorial or workshop that you publish or teach;
3 Selling the finished result of your class for profit;
4 Sharing the contents of any classes on this site on any platform, including blogs, Facebook pages or groups, other learning platforms etc;
5 Copying, sharing or distributing printed or downloadable material;
6 Using the original images from this site without express permission.
